The Freibott Law Firm was successful in a Petition for Additional Compensation Due. The Industrial Accident Board agreed with our position that the claimant had incurred an 8% permanent impairment to his thoracic spine and a 21% permanency impairment to his cervical spine. The defense doctor rated our client with a 7% impairment to the thoracic spine and an 11% impairment to the cervical spine. After hearing testimony from the claimant, and after reading the cross examination conducted by our office of the employer’s expert witness, the Industrial Accident Board found in favor of the claimant and relied upon the claimant’s expert medical witness. Accordingly, the claimant was awarded the 21% impairment to the neck and 8% impairment to the thoracic spine. The Industrial Accident Board also ordered the employer to pay for the claimant’s expert witness fees and attorney’s fees. (Nesci v.
