The Freibott Law Firm was recently successful in defending a claim against one of its clients when the worker’s compensation carrier filed a Petition to Terminate her wage benefits. After hearing from our client’s expert, Dr. John Rowlands, who is Board certified in anesthesiology and pain management, and hearing the credible testimony from our client, the Industrial Accident Board held that our client was entitled to partial disability benefits. The decision was based, partly, on a Functional Capacities Evaluation showing that our client is able to work in a modified duty. Accordingly, the Industrial Accident Board found our client was totally disabled from June 5, 2023 through June 28, 2023 and again from September 20, 2023 through December 6, 2023. Thereafter, the Industrial Accident Board found that the worker’s compensation insurance company must pay partial disability benefits. In addition, since we were successful in defending the worker’s compensation insurance company’s Termination Petition, the Industrial Accident Board awarded our firm an attorney’s fee and reimbursement of our expert witness fee.
