The Freibott Law Firm was recently successful in prosecuting a case on behalf of one of our clients. Our client was originally injured in a compensable work accident on March 24, 2012 wherein she hurt both her left and right leg. She has undergone four surgeries to her left leg and two surgeries to her right leg. Over the course of time, our client began having problems with her low back and right hip that we alleged was causally related to the original 2012 work accident. The Industrial Accident Board agreed with our assessment and awarded the compensability of our client’s low back and hip problems and the treatment that has been rendered to date for each body part. The Industrial Accident Board noted that the testimony of our client’s treating doctor, Dr. Selena Xing, was superior to that of the worker’s compensation insurance company’s expert, Dr. Christian Fras. Accordingly, the Industrial Accident Board awarded that the treatment to our client’s low back and right hip was reasonable, necessary, and related to the original work accident. Our client was also awarded total disability from July 6, 2017 forward. Moreover, the Industrial Accident Board ordered that the worker’s compensation insurance reimburse our firm for the expert witness fee as well as the payment of an attorney’s fee for our successful presentation of the case.
