The Freibott Law Firm was recently successful in defending a Petition to Terminate filed by the Employer in a work-related accident that occurred on August 5, 2013. Our client was severely injured at work when PVC pipes fell on his head causing him to fall unconscious to the floor and again striking his head on the floor. This is the fourth petition for which our firm has been successful in litigation in front of the Industrial Accident Board on behalf of this client. In this case, the worker’s compensation insurance company alleged that our client was able to go back to some form of employment. We hired our client’s medical expert from the Jefferson Headache Center, Dr. Nicole Spare, to testify live at the hearing. The Industrial Accident Board found Dr. Spare very convincing in her testimony and ruled that her testimony was more convincing and reasonable than that of the defense doctor, Dr. Brokaw, a doctor out of Maryland. The Industrial Accident Board found that our client continues not to be capable of working and therefore denied the employer’s Petition to Terminate our client’s total disability benefits. The Industrial Accident Board also ordered the worker’s compensation insurance company to reimburse our firm Dr. Spare’s expert testimony fee and ordered an attorney’s fee to be paid to our firm.
