The Freibott Law Firm was recently successful in representing one of its client seeking additional compensation for his worker’s compensation claim. Our client was injured on March 15, 2021 sustaining a right hip injury from work related motor vehicle collision. Our office filed a Petition seeking Additional Compensation Due for a low back injury. The worker’s compensation insurance carrier contended that the low back injury was unrelated to the work accident. After a hearing, the Industrial Accident Board found our client to be very credible and found our client’s medical expert, Dr. Elliott Leitman, more credible than that of the defense doctor, Dr. Kates. The Industrial Accident Board found that our client sustained an injury to the low back from performing dead lifts in physical therapy related to his acknowledged right hip injury. The reasoning was as follows: But for the work accident, our client would not have needed physical therapy. But for doing deadlifts at physical therapy, our client would not have injured his low back. The Industrial Accident Board agreed. The Industrial Accident Board further ordered the worker’s compensation insurance company to reimburse our medical expert fee for Dr. Leitman’s testimony and ordered an attorney’s fee to be paid by the worker’s compensation insurance company.
