The Freibott Law Firm was recently successful in prosecuting an extremely contentious case on behalf of one of its clients. Our client was severely injured on August 5, 2013 when he worked as a warehouse worker when several PVC pipes fell and struck him on the head causing him to fall onto a concrete floor and strike his head again. Our client sustained an intracranial injury, a subdural hematoma, subdural hemorrhage, a closed head injury, a concussion, and an injury leading to debilitating headaches. Our client’s family doctor forwarded our client to the Jefferson Headache Clinic. While there, our client has undergone botox injections; cranial nerve blocks; cranial intravenous infusions; physical therapy; balance therapy; speech therapy; and occupational therapy. Our client has also treated with numerous medications. The worker’s compensation insurance company requested a Utilization Review from numerous doctors stating that the above referenced treatment was not guideline compliant according to the Delaware Worker’s Compensation Treatment Guidelines. Accordingly, we filed our own Petition to challenge these findings. At an extremely long hearing, the Industrial Accident Board found in favor in our client and held that the client’s doctors, Drs. Cramer, Heath, and Spare, provided credible testimony regarding our client’s treatment in the past and in the future. Accordingly, the Industrial Accident Board accepted these medical testimonies with respect to the reasonableness and necessity of the treatment in its entirety. The Industrial Accident Board ordered the worker’s compensation insurance carrier to reimburse the client for his medical expert witness fees and further ordered that an attorney’s fee be paid to the Freibott Law Firm.
