The Freibott Law Firm was recently successful in pursuing a very complex case on behalf of one of its clients. Our client was originally injured on January 9, 2016 when she was working as a medical health assistant at Meadowood Behavioral Health Hospital. In April of 2017, our client underwent back surgery that did not go well at all. Immediately after surgery, and after our client woke up from anesthesia, she realized that her legs hurt, that she could not use the bathroom; and required emergency treatment from a urologist. Since that time, our client was diagnosed with Complex Regional Pain Syndrome (CRPS); lymphedema (severe swelling) of both her legs; and a bladder injury caused by her low back surgery which has caused bladder and incontinence issues. The Industrial Accident Board found our client to be “incredibly believable.” Moreover, the Industrial Accident Board found that our medical experts, Dr. Xing; Dr. Zaslavsky; and Dr. Meyers were far more credible than that of the defense medical expert, Dr. William Murphy. At Dr. Murphy’s deposition, held the day before the hearing, Dr. Murphy admitted, under cross examination, that the bladder and incontinence issues were related to the back surgery which was also related to the original work injury. Moreover, Dr. Murphy admitted, under cross examination, that the lymphedema in the legs was also related to the surgery. Therefore, the only issue in front of the Industrial Accident Boardwas the CRPS issue, which the Industrial Accident Board found in our favor by relying upon the more credible testimony of our medical experts. Accordingly, the Industrial Accident Board granted our Petition for Additional Compensation Due and denied the Worker’s Compensation Insurance Carrier’s Petition to Terminate our client’s total disability status. The Industrial Accident Board awarded our firm the maximum attorney’s fee and further ordered that the worker’s compensation insurance carrier pay for all of our expert witnesses and our court reporter costs.
