The Freibott Law Firm was recently successful in prosecuting a case on behalf of one our clients in the case of Patton v. New Castle County. Our firm filed a Petition seeking Additional Compensation Due for a permanent injury to our client’s right lower extremity. Our client had been compensated for a 9% impairment rating in 2013 and our current Petition alleged an increase of 6% permanent impairment to the right leg. In this case, the Industrial Accident Board found that our client was very credible in his testimony and found that the testimony of our medical expert, Dr. Jeffrey Meyers, was superior to that of Dr. Evan Crain of First State Orthopaedics. The Industrial Accident Board found that Dr. Meyers’ opinion for the increase of impairment was based on Dr. Meyers’ very thorough physical examination and reliance upon the American Medical Association Guidelines, both 5th and 6th Edition. In the end, the Industrial Accident Board awarded our client the additional 6% impairment rating; ordered New Castle County to pay for Dr. Meyers’ expert witness fee; and ordered New Castle County to pay an attorney’s fee to our firm.
