The Freibott Law Firm was recently successful in prosecuting a claim on behalf of one of its clients in the case of Fahey v. Burke Painting and Coatings, Inc. The worker’s compensation carrier denied this claim from the onset and we filed a Petition to Determine Compensation Due alleging that our client injured his low back, right leg, right knee, and right ankle/foot in a work accident that occurred on December 19, 2016 when our client was painting hallways in an apartment building. Our client was priming and sanding spots on a wall and was walking up a stairway in order to inspect more work. He fell on the steps injuring the above referenced body parts. Our client was found to be very credible during his testimony about the work accident. Moreover, the Industrial Accident Board found that our client’s medical expert, Dr. Eric Johnson, an orthopedic surgeon, provided testimony that was far more credible that than of the defense doctor, Dr. Christian Fras, also an orthopedic surgeon. Accordingly, the Industrial Accident Board ordered the worker’s compensation insurance company to pay our client’s temporary total disability benefit claim, from the date of the accident forward, as well as his outstanding medical expenses. The Industrial Accident Board also ordered the worker’s compensation insurance company to pay Dr. Johnson’s expert witness as well as paying our firm an attorney’s fee for the successful presentation of the case.
