The Freibott Law Firm was recently successful in presenting a disfigurement case on behalf of one of its clients. Our client worked for the State of Delaware as a correction officer and sustained an injury to her knee requiring a total knee replacement. The surgery resulted in a large scar to her knee. In this case, the State of Delaware only offered 15 weeks of compensation to resolve the scarring and disfigurement claim. Our final demand, to the State of Delaware, was for the State to pay 25 weeks of compensation. The Industrial Accident Board heard the case, listened to our client’s testimony, and reviewed and measured our client’s scar. The Industrial Accident Board awarded 25 weeks of compensation. As a result, State of Delaware was also required to pay an attorney’s fee for our successful presentation of the disfigurement claim. (Boyd v. State of Delaware, Hearing No.: 1493260 Date of Decision: September 5, 2022)
