The Freibott Law Firm was successful in front of the Industrial Accident Board when the Board awarded compensation benefits for one of our clients who was injured as a result of an accident where the defense, as alleged by the Employer(Wilmington Housing Authority) that our client was engaged in horseplay at the time of the work injury. On the day of the work accident, our client appeared at his job and, when he began to sit in his chair at his desk, a co-worker pulled the Claimant back in his chair and dropped him to the floor. Our client did not feel that the incident was amusing and had heated words with his co workers. Our client was seriously injured during this incident and sustained a herniated disc at L5-S1 level. After much treatment, our client was left with a permanent back injury. The Industrial Accident Board found our client to be credible over that of the co workers who testified that the incident was just “joking around.” The Industrial Accident Board awarded benefits to our client in the form of total disability benefits; medical benefits; and awarded attorney’s fees and the reimbursement of our client’s expert testimony fees.
