The Freibott Law Firm was recently successful in obtaining permanent impairment benefits for our client in the case of Coger v. PHCMeadowwood. Our client is a 54 year old woman who worked at PHCMeadowwood. Our client is well educated and was honorably discharged from the Army. She also worked for many years as a correction officer, a social worker, and a licensed practical nurse. On the date of the work incident, our client was severely injured when a combative patient at Meadowwood grabbed our client and flung her across the room into a cement wall. Our client hit the wall with her head and the left side of her body. Permanent impairment claims were made for the following areas of our client’s body: 23% impairment to the cervical spine; 8% impairment to the left upper extremity; and 8% impairment to the low back. Dr. Meyers, our client’s medical expert, provided the impairment ratings and was found to be more persuasive and credible than that of the expert hired by the Employer, Dr. Steven Grossinger. Accordingly, the Industrial Accident Board found that our client had sustained a 23% impairment to the cervical spine; 8% impairment to the left upper extremity; and 8% impairment to the low back. The Industrial Accident Board also ordered the Employer to pay for Dr. Meyers’ expert witness fee and to pay an attorney’s fee for the successful presentation of Claimant’s permanency issues.
